How does retirement affect alimony payments in California?

When someone paying alimony retires, it can significantly impact the ongoing payments. In California, the family court may allow for modifications based on retirement, but the process involves several legal considerations.

California law on retirement and alimony modifications

California law recognizes retirement as a legitimate change in circumstances that may justify modifying or terminating alimony. The court evaluates whether the retirement was in good faith and if the payer’s financial situation has changed enough to warrant an adjustment. A well-planned retirement supported by adequate savings can be a key factor in reducing or ending alimony payments.

Factors courts consider when evaluating alimony after retirement

Courts take multiple factors into account when deciding whether to modify alimony due to retirement. These include the payer’s age, health, retirement income, and ability to continue making payments.
