What you should know if your divorce ends up going to court

At our firm, we have a lot of people who come to us looking for assistance with their divorce. While the great majority of these cases are resolved prior to trial, there are instances where it is necessary to head inside the courtroom.

In situations where a trial or hearing will happen, we often will spend time with our clients to prepare them for going to court. We wanted to take a few moments to discuss some of those things with you now, so that you understand more about the divorce process. The more you know, the easier it will be for you as you go through your divorce.

The judge is in control

You may have a lot of things that you want the judge to know. You will want to talk about everything that has happened in your relationship because you think it is important to your case, and it is. It is very important to us when we create the strategy that we will use inside the courtroom, but the judge does not want to get drawn into he-said/she-said discussions.

We will meet with you to explain the issues that will be discussed as part of your divorce. It is possible that only minor matters will need to be addressed, and we want to make sure that you are ready to testify to these items, if it is necessary. You are not going to sit down with the judge and just talk about your case. There is a process, and we will tell you how everything will work in your situation.

Appearances are important

This may be the very first (and last, for that matter) opportunity to make an impression on the court. You have to keep in mind that the way you dress and the way you act will be something that the judge will be watching carefully. If you are wearing inappropriate clothing or not taking the process seriously, this will have an impact on your case.

Focus on issues, not feelings

This is probably the most emotional time in your life. You have so much that you want to let out. You are angry and upset at your spouse. But the courtroom is not the place for those emotions. You need to be in control over your feelings.

When we go to court, we are going there because there are issues that we cannot agree upon with your soon-to-be ex-spouse. Our main focus is presenting your side of the story to the judge in order to receive a ruling that is in your favor.
