Is January the 'Divorce Month'?

When a marriage breaks down, some people have difficulty talking about with friends. Deciding to divorce is a major decision. When the New Year hits many people think about creating New Year’s resolutions and making changes in their lives. The New Year is often a time for reflection.

Some divorce lawyers in California, as across the country, see an increase in calls in January. It may be difficult to pinpoint why that seems to happen. Some people say that stress during the holiday season may be involved. As families gather in November and December, a troubled marriage may see conflicts. Conversely, some individuals (or couples) who have been contemplating divorce may delay filing divorce papers until the holiday season is over.

Commentators may talk about ideas like January is the so-called “divorce month,” or the beginning of the divorce season based upon an apparent trend in people filing for divorce after the New Year begins each year. There may be various databases on divorce rates found on the Internet. The Centers for Disease Control and Prevention tabulates vital statistics. Notably, California is one of a small handful of states in which the CDC does not track divorce rates.

That may raise an interesting point. In reality, no individual divorce is a statistic. Each person seeking legal separation or divorce may have individual issues that are important. California property division, child custody and support and other family law issues may involve legal issues under the law—but, in reality, while guidelines may exist in many areas of family law what is most important in an individual case may vary from others. Seeking to protect rights and a lawful application of the rules of family law in individual issues are not mere statistics.
