Child Support Lawyers Ensuring A Fair Agreement In Alameda County

California child support payments are calculated according to state-established guidelines. This formula considers each parent’s income, earning potential and pre-existing financial obligations, as well as “time share” — how much time the child spends with each parent.

At the Law Offices of John A. Guthrie, we often begin by working with you establish a custody arrangement that makes sense, and then guide you through the process of obtaining a child support order.

Making Sure The Numbers Are Accurate

Our lawyers have been representing families in Alameda County with these tough issues since 1990. We have offices in Pleasanton and Danville and can meet with you at whatever is the most convenient location. Whether you are dependent on child support to stay financially afloat, or worry child support payments will be more than you cannot afford, we are at your service.

The guidelines are only as good as the numbers that are entered in the fields. It’s important to include all income sources, investigate health insurance options and who will provide this coverage, and get the “time share” allowances correct. If you can reach agreement on child support, you may not have to appear in front of a judge. And a higher or lower that guideline amount might be possible based on potential exceptions.

It’s crucial to get support determinations correct the first time, because support modifications down the road are only possible in limited circumstances.

Understanding California’s Modernized Child Support Standards

California’s child support law has undergone its most significant transformation through legislative changes, including Senate Bill 343 and Senate Bill 1055. Under SB 343, California implemented a revised version of the “K-Factor,” which determines the percentage of parental income allocated toward child support. The revised formula is designed to increase support obligations for higher-income earners while reducing those of lower-income parents.

The law also modernized the low-income adjustment system by tying the threshold to California’s minimum wage standards rather than fixed-income tables. Add-on expenses such as work-related childcare costs and uninsured medical expenses are no longer automatically divided equally between parents. Instead, courts generally allocate these costs proportionally based on each parent’s net disposable income.

As a parent, you also have additional time, expanded from 30 days to 90 days, to request reimbursement for qualifying add-on expenses. Our child support attorney can work with you to help ensure the support orders reflect these modernized standards.

Passport Revocation For Unpaid Child Support In California

Under federal law, a parent who owes more than $2,500 in child support arrears may be denied a passport or have an existing one revoked. California’s Department of Child Support Services (DCSS) cooperates with federal agencies to identify these parents and ensure the support orders are enforced.

A passport restriction can create serious personal and professional hardships, particularly when international travel is necessary for employment. As such, if you have accumulated arrears, it is important to act quickly with our child support lawyer. We can help pursue appropriate modifications to ensure your interests are protected.

Providing You With Strong Legal Support In Revising Your Out-Of-Date Orders

California’s child support laws have changed substantially, and many support orders established before 2025 may no longer reflect current legal standards. We can help you review the support order if:

  • Your income has increased or decreased by 10% or more
  • Your support order is more than three years old
  • You are paying half of all uninsured medical costs despite a substantial income imbalance
  • Your employment situation has significantly shifted

Since support does not automatically change with your financial circumstances, we can help you formally request a modification. Our attorney can help gather the necessary financial documentation, seek agency reviews when appropriate and file Requests for Order in Alameda County Superior Court, Family Support Division (FSD).

Enforcement And Post-Divorce Modifications

The state of California not only determines child support amounts: It also collects and distributes child support payments. Based on this role, the state has resources at its disposal to ensure payments are made, including garnishing wages or suspending driver’s licenses. For this reason, it is a good idea to contact a qualified attorney before you fall behind in your payments.

Our law firm can also help modify an existing child support order when circumstances change due to illness, lack of employment or something similar. Likewise, if the partner paying support is now making more money, a modification to increase payments may be possible. We’ll help you understand your options and seek tailored solutions to your particular problems.
